Purpose and scope
These Terms of Service govern access to and use of the website canariasapart.com (hereinafter, the "Platform"), owned by Teneryfa Apart S.L. (Tax ID: B75643361, Calle Herrero 3/14, 38677 Tijoco Bajo, Adeje, Santa Cruz de Tenerife, Spain). By accessing, browsing or using the Platform, the user agrees to be bound by these terms. If you do not agree with any of them, you must refrain from using the Platform.
Description of services
The Platform offers a vacation rental intermediation and management service in the Canary Islands. Through it, users can check property availability, make bookings, process payments and manage their stay. Teneryfa Apart S.L. acts as professional manager of the published vacation properties, handling guest support, maintenance and comprehensive property management on behalf of owners.
Booking process
- The booking is considered confirmed once the deposit or full payment is received, according to each property's policy.
- The guest will receive a confirmation email with booking details, arrival instructions and contact information.
- Prices shown on the Platform include accommodation and basic services indicated in each property listing. Optional extras are charged separately.
- The guest must provide truthful and up-to-date information. False data may result in booking cancellation without refund.
- The minimum age to make a booking is 18 years. The booking holder must be one of the guests staying at the property.
Payments and prices
All prices are expressed in euros (€) and include applicable taxes (IGIC in the Canary Islands). Payment is processed through secure payment gateways. Depending on each property's policy, a deposit may be required at the time of booking with the balance due before arrival. The security deposit, where applicable, is charged as a percentage of the total stay amount and is refunded after verification of the property's condition at checkout.
Cancellation policy
Each property may have its own cancellation policy, clearly displayed in the property listing and in the booking confirmation email. In general terms: cancellations made more than 30 days before check-in are entitled to a deposit refund less management fees; cancellations between 15 and 30 days before check-in are entitled to a 50% deposit refund; cancellations less than 15 days before check-in are not entitled to any refund. In case of no-show, no refund will be made. Teneryfa Apart S.L. reserves the right to cancel a booking in exceptional circumstances (force majeure, property damage), offering an equivalent alternative or full refund.
Guest obligations
- Use the property responsibly and in accordance with its purpose as vacation accommodation.
- Respect community coexistence rules and property-specific regulations.
- Not exceed the maximum capacity indicated in the property listing.
- Immediately report any damage or incident occurring during the stay.
- Leave the property in reasonable order and cleanliness at checkout.
- Comply with current regulations on noise, waste and neighbourhood coexistence.
- Provide necessary documentation for the legally required traveller registration.
Limitation of liability
Teneryfa Apart S.L. shall not be liable for damages arising from circumstances beyond its reasonable control, including natural disasters, basic supply failures (water, electricity, internet), works in common areas or governmental measures. The maximum liability of Teneryfa Apart S.L. towards the guest, for any reason, shall be limited to the total amount paid for the booking. The Platform is provided "as is" without additional warranties beyond those legally required.
Intellectual property
All content on the Platform (texts, images, logos, design, source code, databases) is owned by Teneryfa Apart S.L. or its licensors and is protected by intellectual and industrial property laws. Reproduction, distribution, public communication or transformation without express written authorisation is prohibited.
Applicable law and jurisdiction
These Terms are governed by Spanish law. For any dispute arising from the use of the Platform or the contracting of services, the parties submit to the Courts of Santa Cruz de Tenerife, unless consumer regulations grant the user another preferential jurisdiction. If the user qualifies as a consumer under applicable law, these terms shall not limit any rights they are legally entitled to.
Modifications
Teneryfa Apart S.L. reserves the right to modify these Terms of Service at any time. Changes will be published on this page with the last update date. Continued use of the Platform after publication of modifications implies acceptance of the new terms.
